5. Typographical errors
5.1. In the event that a product or service on the website is listed at an incorrect price, specification, application, or with inaccurate technical details, 4REVISION ENGINES reserves the right to refuse or cancel any orders placed for that product or service, whether or not the order has been confirmed and payment has been processed.
5.2. If payment has already been made for a product or service listed in error, 4REVISION ENGINES reserves the right to cancel the transaction and issue a full refund to the original payment method, without further obligation or liability.
5.3. 4REVISION ENGINES shall not be held responsible or liable for any losses, damages, or consequences arising directly or indirectly from typographical errors, data inaccuracies,
misstatements, or misleading content displayed on the website, including incorrect applications or product compatibility.
Although 4REVISION ENGINES makes every reasonable effort to ensure that all content on the website is accurate, clear, and up to date, typographical or informational errors may occasionally occur. Such errors are unintentional, and we continuously strive to provide correct and reliable information to our users and customers.

5.7. In the event of discrepancies between different language versions of these Terms and Conditions or other site content, the English version shall prevail as outlined in Section 23.4.

6.1. 4REVISION ENGINES, in its sole discretion, may display advertisements, sponsored content, or promotional material from third parties on the website. These advertisements may be presented in the form of banners, links, affiliate promotions, or other formats.
6.2. 4REVISION ENGINES does not endorse, verify, or guarantee any products, services, claims, or offers made by third-party advertisers. The inclusion of advertisements on the website does not constitute a recommendation or approval of the advertised content.
6.3. Any transactions, correspondence, or interactions that occur between the user and any third party advertiser are solely between the user and the advertiser. 4REVISION ENGINES shall not be held responsible or liable for any loss or damage arising from such dealings or from the mere presence of such advertisements on the website.

7. Quotations
7.1. All quotations issued by 4REVISION ENGINES are free of charge and remain valid for a period of fourteen (14) calendar days from the date of issuance, unless otherwise stated in writing. Quotations shall automatically lapse after this period.
7.2. Any delivery dates, lead times, or other time-related estimates mentioned in a quotation are indicative only and shall not be considered binding or guaranteed. These estimates are provided solely for informational purposes and may be subject to change.
7.3. All quoted prices are exclusive of VAT (Value Added Tax), unless explicitly stated otherwise. Additional costs such as shipping fees, customs duties, handling charges, or installation services are not included unless specifically mentioned.
7.4. 4REVISION ENGINES reserves the right to revoke or cancel any quotation within two (2) business days after the quotation has been received by the customer, without the need to provide any justification or reason for such revocation.
7.5. Quotations are non-binding, free of any legal commitment, and intended solely as an invitation
to negotiate. The final price may vary depending on updated specifications, market conditions, availability, or technical adjustments.
7.6. Quotations are subject to change or correction in the event of typographical errors, pricing miscalculations, supplier cost fluctuations, or material availability. 4REVISION ENGINES shall not be held liable for such modifications prior to formal order confirmation.
7.7. A quotation shall not be considered a legally binding offer. A binding agreement is only established once the customer’s acceptance is confirmed in writing by 4REVISION ENGINES through an official order confirmation.
8. Payments
8.1. All payments to 4REVISION ENGINES must be made using valid and accepted payment methods. The company reserves the right to reject or cancel any order submitted with an unauthorized or invalid payment method.
8.2. Any additional charges, such as transaction fees, currency conversion costs, or international bank charges, shall be borne exclusively by the customer.
8.3. For all website purchases, payment must be made in full prior to shipment or delivery. Orders will not be processed, fulfilled, or shipped until payment has been successfully received and confirmed by 4REVISION ENGINES.
8.4. All payments must be made in full without any deductions, deferrals, withholdings, or set-offs, unless explicitly agreed upon in writing by 4REVISION ENGINES.
8.5. If, by explicit agreement and at the sole discretion of 4REVISION ENGINES, post-payment is permitted, the customer must settle the full invoice amount within fourteen (14) calendar days from the invoice date.
8.6. In the event that payment is not received within the specified term, a formal reminder will be issued. If the outstanding amount remains unpaid three (3) business days after such reminder, 4REVISION ENGINES reserves the right to: (a) charge interest on the overdue amount at a rate of 1% per month (equivalent to 12% per annum) or the statutory commercial interest rate under Dutch law, whichever is higher; and (b) apply fixed extrajudicial collection costs of 15% of the principal amount, with a minimum of €30.
If 4REVISION ENGINES incurs higher actual costs that are reasonable and demonstrable, the customer shall also be liable for those additional expenses.
8.7. In the event of liquidation, bankruptcy, suspension of payments, or any comparable legal procedure affecting the customer, all outstanding invoices shall become immediately due and payable. 4REVISION ENGINES reserves the right to pursue full recovery of all debts, including through legal action or claims in the bankruptcy estate.
8.8. All additional costs, legal fees, administrative charges, and other expenses incurred by 4REVISION ENGINES as a result of delayed, partial, or non-payment by the customer shall be borne entirely by the customer. Any payments made by the customer shall first be applied to accrued interest and costs, and then to the oldest outstanding principal amounts, regardless of the customer’s payment instructions.
8.9. Title to any goods or products supplied by 4REVISION ENGINES shall remain with the company until full payment has been received. Ownership rights will only transfer to the customer upon receipt of the full invoiced amount.
8.10. 4REVISION ENGINES reserves the right to assign or transfer unpaid invoices to third-party debt collection agencies or legal representatives without further notice to the customer.
8.11. In the event of late or non-payment, 4REVISION ENGINES reserves the right to suspend or cancel any pending deliveries, services, or contractual obligations until all outstanding amounts have been settled in full.
8.12. Payments made through the website are processed via third-party payment service providers (PSPs). 4REVISION ENGINES shall not be held liable for any delays, errors, rejections, interruptions, or technical failures in payment processing that result from the actions or systems of such third parties. The customer agrees to comply with any applicable terms and conditions imposed by the relevant payment service provider.
9. Prices
9.1. All prices listed by 4REVISION ENGINES are expressed in euros (EUR) and are exclusive of value added tax (VAT), shipping, handling, and any other applicable charges, unless explicitly stated otherwise.
9.2. Prices are subject to change at any time without prior notice due to fluctuations in market conditions, supplier rates, currency exchange, manufacturing costs, transportation expenses, or other operational factors.
9.3. If a price agreement has been made between 4REVISION ENGINES and the customer, and it is subsequently demonstrated that the actual cost of goods or services has increased substantially, 4REVISION ENGINES reserves the right to adjust the agreed-upon price accordingly. Justification for such adjustments must be supported by objective evidence, including but not limited to changes in material costs, labor costs, currency exchange rates, or unforeseen external circumstances occurring after the conclusion of the agreement that significantly affect pricing.
9.4. In the event that the adjusted price results in a total increase of more than twenty percent (20%) compared to the original agreed price, the customer is entitled to cancel the contract without incurring liability for damages, lost profits, or any other financial consequences. Cancellation must be communicated in writing within five (5) business days of receiving notice of the price increase.
9.5. Price adjustments may also apply to pending offers, open quotations, or backorders, unless expressly agreed otherwise in writing.
9.6. Unless otherwise stated, listed prices do not include any costs related to transport, packaging, insurance, or administrative processing, which may be invoiced separately and are the responsibility of the customer.
9.7. Any pricing displayed on the website, in quotations, or in promotional materials is subject to correction in the event of typographical or clerical errors. Such errors do not constitute binding offers. This includes, but is not limited to, incorrect numerical values, outdated discounts, or misprinted VAT information.
9.8. All price indications provided by 4REVISION ENGINES, whether listed on the website, in quotations, or in any correspondence, are non-binding and do not constitute a formal offer unless expressly confirmed in writing as a fixed offer by 4REVISION ENGINES.
9.9. Prices are only valid for confirmed written orders and apply solely to the products, quantities, and conditions specified in the corresponding confirmation by 4REVISION ENGINES.
10. Discounts and promotions
10.1. All discounts, sale prices, promotional rates, or special offers made available by 4REVISION ENGINES are valid only during the clearly stated promotional period and under the specified conditions. Once the promotional period has expired, the standard pricing will apply without exception.
10.2. 4REVISION ENGINES reserves the right to modify, suspend, or terminate any promotion, discount, or campaign at its sole discretion and without prior notice, even if such a promotion was previously advertised or communicated.
10.3. Discounts and promotional offers are only valid if all applicable terms and conditions specified in the promotion are met by the customer. Failure to comply with these conditions may result in
disqualification from the offer.
10.4. Unless explicitly stated otherwise, discounts, vouchers, and promotional offers may not be combined with other ongoing promotions, campaigns, or price reductions.
10.5. Promotional prices and discounts cannot be applied retroactively. Customers who purchased products or services prior to the start of a promotion are not entitled to claim any reimbursement or compensation based on subsequently introduced offers.
10.6. Any misuse, manipulation, or fraudulent activity related to the use of discounts or promotions—such as creating duplicate accounts, unauthorized sharing of coupon codes, or circumventing eligibility requirements—shall result in immediate disqualification from the offer and may lead to the cancellation of the associated transaction.
10.7. All promotional offers are subject to availability. 4REVISION ENGINES does not guarantee the continued availability of promotional products, services, or bundles and reserves the right to limit quantities or discontinue availability without notice. No rainchecks or retroactive claims will be honored for out-of-stock promotional items.
11. Refunds
11.1. All refund requests are subject to review and approval by 4REVISION ENGINES management. Operational or support staff are not authorized to commit to or approve refund decisions.
11.2. Eligible refunds will be processed within thirty (30) calendar days from the date of approval. Refunds shall be issued via credit card or bank transfer to the original payment method used at the time of purchase, unless otherwise agreed in writing. Customers will receive written confirmation of the refund transaction upon completion.
11.3. Refunds are only applicable to verified and approved cases, including valid cancellations, defective product claims, or returns that comply with our return policy. Unsubstantiated or unauthorized refund requests will be denied.
11.4. Deposits made for service appointments, assessments, diagnostics, or reservations are strictly non-refundable, regardless of attendance, cancellation, or outcome.
11.5. No refunds will be issued in cash under any circumstances.
11.6. Issuing a refund shall not constitute or be interpreted as an admission of fault, liability, negligence, or legal obligation by 4REVISION ENGINES or any of its representatives.
11.7. The customer is solely responsible for ensuring that all banking and refund account details provided are correct. 4REVISION ENGINES shall not be liable for any loss, delay, or failed transaction resulting from inaccurate or incomplete information supplied by the customer.
11.8. Customized, modified, or special-order products are excluded from refunds unless proven to be defective and covered under applicable warranty terms.
12. Product and recall
12.1. 4REVISION ENGINES reserves the right to initiate a product recall or withdrawal at any time if it is determined that the product fails to meet applicable safety, quality, legal, or performance standards, or presents a potential risk to users or third parties.
12.2. In the event of a product recall, customers are required to fully cooperate and follow all instructions issued by 4REVISION ENGINES regarding the return, replacement, or disposal of the affected product(s).
12.3. Products must be returned within the specific time window communicated in the recall notice. Failure to do so may result in the forfeiture of any right to return, repair, replacement, or support related to the recalled product. 4REVISION ENGINES will not be held responsible for continued use of recalled products beyond the designated period.
12.4. Unless explicitly stated otherwise in writing, customers are not entitled to compensation,
damages, or reimbursement beyond the scope of the recall, such as replacement or repair. No claims shall be accepted for consequential loss, business interruption, or indirect damages caused by the recall.
12.5. Recall rights apply exclusively to the original purchaser and are non-transferable. Products obtained through resale, second-hand channels, or unauthorized distributors may not be eligible for participation in a recall program.
12.6. Products that show evidence of misuse, neglect, unauthorized modification, or damage unrelated to the recall issue will be excluded from the recall process and shall not be eligible for replacement or refund.
12.7. 4REVISION ENGINES reserves the right to determine on a case-by-case basis whether return shipping costs will be covered by the company or the customer. Any unauthorized or unapproved return shipments may be refused.
13. SAMPLES, MODELS AND EXAMPLES
13.1. Any samples, demonstration products, models, illustrations, photographs, mock-ups, prototypes, or example specifications provided by 4REVISION ENGINES are intended solely to offer a general indication of the goods or services and do not form part of any contractual specification unless explicitly agreed in writing.
13.2. The characteristics, appearance, performance, fitment, dimensions, materials, and functions of the final product may differ from the sample, model, or example. No rights may be derived by the customer from any such deviations.
13.3. Customers may not derive any legal rights, guarantees, or expectations from the provision, presentation, or use of a sample, model, or example unless otherwise expressly confirmed by 4REVISION ENGINES in a binding written agreement.
13.4. Any demonstration or sample products provided by 4REVISION ENGINES remain the sole property of the company unless explicitly sold or transferred under written agreement. Upon request, the customer shall return any demo or sample product in its original condition. Damage, loss, or unauthorized retention may result in charges to the customer.
13.5. Samples or models do not imply any performance guarantees, technical suitability, or fit-for purpose certification regarding the delivered goods or services unless expressly confirmed by 4REVISION ENGINES.
13.6. Customers are prohibited from reproducing, reverse-engineering, or distributing any samples, models, or examples without prior written consent from 4REVISION ENGINES. All intellectual property rights in and to the sample materials remain with 4REVISION ENGINES or its licensors.
13.7. Any deviation between a sample and a final delivered product shall not constitute grounds for cancellation, compensation, or liability unless the deviation is proven to be material and contrary to an explicitly confirmed agreement.
14. Services
14.1. 4REVISION ENGINES may provide services including but not limited to diagnostics, inspection, repairs, maintenance, technical consulting, or installation. Such services may be offered independently or in conjunction with the purchase of products. All services are rendered on a best effort basis and do not guarantee any specific result or performance unless expressly agreed in writing.
14.2. Service appointments must be scheduled in advance. Appointments may require a deposit, which is non-refundable unless explicitly stated otherwise. Cancellations or rescheduling must be made at least forty-eight (48) hours prior to the scheduled time. Failure to provide timely notice may result in the forfeiture of any paid deposit or the imposition of a cancellation fee.
14.3. 4REVISION ENGINES shall not be liable for indirect, incidental, or consequential damages
resulting from the provision, delay, interruption, or failure of services, unless caused by gross negligence or willful misconduct.
14.4. Customers are responsible for ensuring accurate information is provided and that working conditions at the service location are safe, accessible, and appropriate. Any failure by the customer to fulfill these obligations may result in delays, additional charges, or cancellation of the service.
14.5. All service tools, diagnostic equipment, software, methods, technical data, and procedures used during the execution of services remain the sole property of 4REVISION ENGINES or its licensors and may not be copied, altered, or reused by the customer without written consent.
14.6. If applicable, 4REVISION ENGINES may provide written documentation, such as service reports, inspection summaries, or technical notes. These documents are issued for informational purposes only and do not constitute a certificate of compliance or guarantee of condition unless explicitly stated.
14.7. Warranty terms for services, if applicable, are governed exclusively by the provisions outlined in the Warranty terms.
15. Warranty
15.1. All warranty terms, coverage limitations, procedures, and exclusions applicable to products and services offered by 4REVISION ENGINES are governed by a separate document titled “Warranty Policy”. This policy is an integral part of the overall contractual framework and applies in conjunction with these Terms and Conditions.
15.2. By purchasing or using any product or service provided by 4REVISION ENGINES, the customer agrees to the terms outlined in the Warranty Policy.
15.3. The Warranty Policy is available upon request and can be accessed digitally via our website or through customer support. It is the customer’s responsibility to review the Warranty Policy before placing an order or submitting a warranty claim.
15.4. In the event of a discrepancy between these Terms and Conditions and the Warranty Policy, the Warranty Policy shall take precedence with respect to matters specifically related to warranty rights, obligations, and procedures.
16. Shipping
16.1. All orders are shipped using the carrier deemed most suitable by 4REVISION ENGINES. Although 4REVISION ENGINES primarily utilizes UPS for most shipments, it reserves the right to use alternative carriers (such as DHL, FedEx, or local couriers) based on cost, destination, delivery requirements, or operational considerations. We reserve the right to substitute the chosen shipping method without notice.
16.2. Unless explicitly agreed otherwise, all shipments are made using the most cost-effective shipping method available. Customer preferences for carriers or delivery methods may incur additional charges and must be agreed upon in writing. In cases where free shipping is offered, 4REVISION ENGINES reserves the right to choose the lowest-cost delivery method, regardless of any preferences indicated by the customer.
16.3. All shipments are made at the customer’s risk unless explicitly agreed otherwise in writing. 4REVISION ENGINES shall not be liable for any loss, damage, or delay that occurs during transportation under standard shipping terms. In the event of visible damage upon delivery, the customer must notify the delivery driver immediately and ensure the damage is recorded on the carrier’s delivery documentation.
16.4. 4REVISION ENGINES only assists with transport-related loss or damage if (a) the customer has explicitly requested insured shipping in writing prior to dispatch, and (b) 4REVISION ENGINES has confirmed in writing that the shipment was insured accordingly. In such cases, assistance is limited to the procedures and coverage offered by the shipping insurer. For all other shipments, the customer is
solely responsible for initiating and managing claims directly with the carrier. Uninsured or standard shipments are entirely at the customer’s own risk.
16.5. Title and risk of loss transfer to the customer at the moment the goods are handed over to the shipping carrier, unless explicitly agreed otherwise in writing.
16.6. All shipping costs are exclusive of customs duties, taxes, import fees, clearance charges, or other government-imposed costs. The customer is solely responsible for complying with all applicable import regulations in their country and for paying all related costs. 4REVISION ENGINES is not liable for delays, confiscations, or penalties resulting from import issues.
16.7. The customer is responsible for ensuring that the shipping address provided is accurate and complete. Failed deliveries resulting from incorrect or incomplete address information are the sole responsibility of the customer.
16.8. If a shipment is returned to 4REVISION ENGINES due to refusal of delivery, non-payment of import duties, or failure to claim the parcel, any associated return costs, additional shipping fees, or storage costs shall be borne by the customer.
16.9. Estimated delivery dates are for informational purposes only and are not binding. 4REVISION ENGINES shall not be liable for delays in delivery caused by carriers, customs, strikes, force majeure, or any other circumstances beyond its reasonable control. Any stated delivery date does not constitute a firm deadline and shall not be interpreted as a contractual commitment. Delays shall not constitute grounds for cancellation, damages, or legal claims unless explicitly agreed otherwise in writing. If the customer alters the order after confirmation, the estimated delivery date may be extended accordingly.
16.10. Upon dispatch, 4REVISION ENGINES will provide tracking details when available. These will be sent to the email address supplied by the customer. The accuracy and availability of tracking data depend on the carrier used.
16.11. For shipments involving oversized goods, pallets, crates, or freight requiring special handling or liftgate service, the customer must ensure that suitable unloading facilities and access are available at the delivery location. Any additional costs arising from failed delivery attempts, handling delays, storage charges, or re-delivery due to insufficient access or preparedness shall be invoiced to the customer.
16.12. If the customer opts to pick up the goods directly from 4REVISION ENGINES’ premises or a designated location, the customer must schedule the pickup in advance and adhere to any stated collection procedures. Title and risk of loss transfer to the customer at the moment the goods are handed over. 4REVISION ENGINES shall not be liable for any damage or loss that occurs after the
goods have been collected by the customer or their representative.
17. Limitation of liability
17.1. 4REVISION ENGINES shall only be liable for direct damages suffered by the customer that are the direct and exclusive result of a proven and attributable breach of contract by 4REVISION ENGINES. Liability is excluded in all other cases.
17.2. In all circumstances, the total cumulative liability of 4REVISION ENGINES and its affiliates— whether based in contract, tort (including negligence), breach of statutory duty, or otherwise—shall be limited to the total net purchase price (excluding VAT) of the specific product or service giving rise to the claim. This limitation applies per claim and in aggregate, regardless of the number of claims, damages, or incidents arising from the same or related cause.
17.3. 4REVISION ENGINES shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to: (a) loss of revenue or profit, (b) loss of business or anticipated savings, (c) loss of data, (d) loss of reputation or goodwill, (e) downtime or interruption of operations, (f) or any costs related to substitute goods or services,
even if 4REVISION ENGINES has been advised of the possibility of such damages.
17.4. No liability shall arise for damages resulting from:
(a) force majeure as defined in Section 18,
(b) incorrect, incomplete, or unclear information supplied by the customer,
(c) customer failure to follow usage instructions or technical guidelines,
(d) third-party actions or integrations not under 4REVISION ENGINES’ control, (e) or unauthorized alterations or misuse of the delivered goods or services.
17.5. The customer is obliged to notify 4REVISION ENGINES of any alleged damage or loss in writing within five (5) business days of becoming aware of the issue. Failure to do so shall result in waiver of any right to claim compensation.
17.6. Any technical or legal advice provided by 4REVISION ENGINES is given to the best of its knowledge, but without liability. Customers remain solely responsible for assessing the suitability of products or services for their intended use.
17.7. Nothing in these Terms and Conditions shall exclude or limit liability in cases where such exclusion or limitation is prohibited by applicable law, such as in the event of intentional misconduct or gross negligence.
18. Force majeure
18.1. If 4REVISION ENGINES is delayed, hindered, or prevented from fulfilling its contractual obligations due to circumstances beyond its reasonable control (“Force Majeure”), it shall not be held liable for any resulting damage, delay, or non-performance. In such cases, 4REVISION ENGINES may, without judicial intervention and without incurring liability, (a) suspend the affected obligations, or (b) terminate the agreement in whole or in part.
18.2. Force Majeure events include, but are not limited to: (a) employee illness or absenteeism; (b) epidemics, pandemics, or official quarantine restrictions; (c) operational disruptions such as power failure, fire, or flooding; (d) defects in tools, machinery, or materials; (e) failure or delays by suppliers, subcontractors, or transporters; (f) scarcity or unavailability of raw materials, labor, energy, or transport capacity; (g) strikes, lockouts, civil unrest, or war (declared or undeclared); (h) government actions, embargoes, sanctions, or regulatory changes; (i) natural disasters or extreme weather conditions. These circumstances also apply if encountered by 4REVISION ENGINES’ suppliers, manufacturers, carriers, or other third parties involved in fulfilling the contract.
18.3. If 4REVISION ENGINES has already partially fulfilled its contractual obligations prior to the Force Majeure event, or can only fulfill part of them, it may invoice the customer separately for the fulfilled or fulfillable portion. The customer shall pay this invoice as if it concerned a separate agreement.
18.4. 4REVISION ENGINES shall notify the customer as soon as reasonably possible of the occurrence of a Force Majeure event and the expected impact on its contractual obligations. 18.5. If the Force Majeure situation continues for more than thirty (30) consecutive calendar days, both parties shall be entitled to terminate the affected agreement in writing, without judicial intervention and without the right to claim damages or compensation.
19. Confidentiality and data privacy
19.1. In the course of executing any agreement, 4REVISION ENGINES may disclose confidential business-related information to the customer, including but not limited to: product specifications, internal processes, strategic plans, pricing structures, marketing materials, designs, software, documentation, or other proprietary information (“Confidential Information”).
19.2. The customer agrees to: (a) maintain all Confidential Information in strict confidence, (b) use such information solely for the performance of the relevant agreement, and (c) restrict access to such information only to employees or agents on a strict need-to-know basis, who are also bound by confidentiality obligations.
19.3. The customer is fully responsible for any breach of confidentiality by its employees, representatives, contractors, or agents.
19.4. The confidentiality obligations outlined in this section shall remain in force indefinitely, including after the expiration or termination of any agreement between the parties.
19.5. Upon written request by 4REVISION ENGINES, the customer must return or securely destroy all physical and digital copies of Confidential Information in its possession, unless otherwise legally required to retain such data.
19.6. The obligations of confidentiality shall not apply to information that: (a) is already known by the customer without an obligation of confidentiality, (b) becomes publicly available through no fault of the customer, (c) is lawfully disclosed to the customer by a third party without breach of any duty, or (d) must be disclosed under applicable law or by court order (provided that prior notice is given to 4REVISION ENGINES where legally permissible).
19.7. 4REVISION ENGINES may process and store personal data provided by the customer in accordance with applicable privacy laws and its published Privacy & Cookie Policy. Personal data may be shared with affiliated entities or third-party service providers strictly for the purpose of fulfilling contractual obligations. For more information, customers are referred to the Privacy & Cookie Policy available on our website, which forms an integral part of these Terms and Conditions.
19.8. The customer is responsible for reviewing and understanding the Privacy & Cookie Policy of 4REVISION ENGINES, which forms an integral part of these Terms and Conditions.
19.9. 4REVISION ENGINES shall not be held liable for any unintended disclosure of Confidential Information due to events beyond its reasonable control, including but not limited to cyberattacks, data breaches, or third-party misconduct—unless such disclosure results from gross negligence or willful misconduct.
20. Severability
20.1. If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or competent authority, such provision shall be deemed severed from the remainder of the agreement, and the validity and enforceability of the remaining provisions shall not be affected.
20.2. The parties shall negotiate in good faith to replace any invalid or unenforceable provision with a valid, enforceable provision that most closely reflects the original intent and economic effect of the invalidated clause.
20.3. Provisions of these Terms and Conditions that by their nature should survive termination (including, but not limited to, those regarding liability, intellectual property, confidentiality, and applicable law) shall remain in effect after the termination or expiration of any agreement between the parties.
20.4. If any invalid provision can be interpreted in such a way that it becomes valid and enforceable to the minimum extent permitted by law, it shall be so interpreted rather than being struck entirely.
21. Changes to terms and conditions
21.1. 4REVISION ENGINES reserves the right to amend, update, or revise these Terms and Conditions at any time and at its sole discretion. Any such modifications will become effective immediately upon being posted on the website or communicated through other appropriate channels.
21.2. Customers are responsible for reviewing the Terms and Conditions periodically. Continued use of the website, products, or services after changes have been posted constitutes acceptance of those changes.
21.3. Unless expressly stated otherwise, any amendments shall not apply retroactively to contracts already concluded prior to the date of change.
22. Governing law & jurisdiction
22.1. This agreement and any dispute arising out of or in connection with it shall be governed by and construed exclusively in accordance with the laws of the Netherlands. Conflict-of-law rules or international law provisions that may result in the application of another legal system are excluded.
22.2. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to this agreement and is expressly excluded.
22.3. All disputes, claims, or proceedings—whether contractual, non-contractual, or otherwise— arising from or relating to the legal relationship between the parties shall be submitted exclusively to the competent civil court in Amsterdam, the Netherlands, unless otherwise explicitly agreed in writing by 4REVISION ENGINES.
22.4. The customer irrevocably consents to the jurisdiction of the courts in Amsterdam and waives any objection based on venue, jurisdiction, or forum non conveniens.
22.5. Notwithstanding the above, 4REVISION ENGINES reserves the right to bring proceedings against the customer in the courts of the customer’s domicile or in any other competent jurisdiction, at its sole discretion.
23. Entire agreement and final provisions
23.1. These Terms and Conditions, together with any written order confirmation or signed agreement, constitute the entire agreement between the customer and 4REVISION ENGINES regarding the subject matter herein. They supersede and replace all prior or contemporaneous agreements, understandings, representations, negotiations, or communications, whether oral or written, relating to the same subject. Any separate policies explicitly referred to herein (e.g., Warranty Policy, Privacy & Cookie Policy) form an integral part of this agreement.
23.2. No amendment, modification, or waiver of any provision of these Terms and Conditions shall be binding unless it is made in writing and duly signed by an authorized representative of 4REVISION ENGINES.
23.3. Failure by 4REVISION ENGINES to enforce any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision, nor shall it affect the enforceability of that or any other provision.
23.4. In the event of discrepancies between translations of these Terms and Conditions, the English version shall prevail. Translated versions are provided for convenience only and have no legal force.
23.5. All official communication, including inquiries, support, disputes, and legal correspondence, shall be conducted in English unless otherwise agreed in writing.
24. Compliance
24.1. The customer represents and warrants that all use of products or services purchased from 4REVISION ENGINES shall comply with all applicable laws, regulations, and international standards, including but not limited to export control, customs, tax, environmental, and product safety laws.
24.2. The customer shall not use, resell, export, re-export, or otherwise transfer any goods or services purchased from 4REVISION ENGINES to any individual, entity, or country subject to trade sanctions, embargoes, or other restrictive measures imposed by the European Union, the United Nations, the United States, or any other relevant authority.
24.3. The customer confirms that it is not located in, nor acting on behalf of, any entity or person based in a country subject to comprehensive trade restrictions, and is not listed on any government issued sanctions list, including but not limited to the EU Sanctions List, OFAC SDN List, or UK Sanctions List.
24.4. The customer shall indemnify and hold harmless 4REVISION ENGINES from and against any fines, penalties, damages, or costs (including legal fees) arising from the customer’s failure to comply
with applicable export, trade, or customs regulations.
24.5. 4REVISION ENGINES reserves the right to refuse, suspend, or cancel any order or contractual relationship without liability if there is reason to believe that fulfilling the order would violate applicable law, pose a sanctions risk, or damage the company’s legal or ethical standing.
25. Consumer term (B2C-specific)
25.1. This section applies exclusively to customers who qualify as consumers under applicable consumer protection laws (i.e., individuals acting outside their trade, business, or profession).
25.2. Consumers have the right to withdraw from the purchase agreement within fourteen (14) calendar days without giving any reason. The withdrawal period starts: (a) for goods: on the day the consumer receives the product; (b) for services: on the day the agreement is concluded. To exercise this right, the consumer must notify 4REVISION ENGINES by email or in writing. A model withdrawal form is available on request.
25.3. The right of withdrawal does not apply to: (a) Products that are custom-made, modified to customer specifications, or clearly personalized; (b) products delivered with a tamper-evident or security seal, where the seal has been broken, damaged, or removed after delivery, and the product is no longer suitable for return due to safety, integrity, or hygiene concerns; (c) race or motorsport products, which by their nature are subjected to extreme conditions and usage. These are excluded from withdrawal unless agreed otherwise in writing.
25.4. If the consumer exercises the right of withdrawal, 4REVISION ENGINES shall refund the full purchase price, including standard delivery costs, within fourteen (14) days after receiving the returned goods or valid proof of return. The consumer shall bear the cost of return shipping unless explicitly agreed otherwise. Returned products must be unused, undamaged, and in original packaging.
25.5. All consumers are entitled to the legal warranty under Dutch and EU law. This means that products must function as reasonably expected for their intended purpose. No commercial warranty is provided unless explicitly stated. This does not affect consumers’ statutory rights.
25.6. Products specifically designed for motorsport, racing, competition, or high-performance use are subject to extreme operational stress and are therefore sold without any commercial warranty regarding wear, breakage, durability, or fitness for a particular purpose. These products are sold “as is” and are used entirely at the consumer’s own risk. Due to their nature, these items may degrade faster or fail under intensive use, and such outcomes do not constitute grounds for warranty claims, refunds, or liability. This exclusion of commercial warranty does not affect or limit the consumer’s statutory rights under applicable Dutch or EU consumer protection laws. Legal conformity guarantees remain applicable, meaning products must match the contract at the time of delivery. Consumers are strongly advised to use such products only for their intended non-road use, and in accordance with all technical guidelines and installation instructions. Any misuse, improper installation, or deviation from intended purpose may void any applicable rights and release 4REVISION ENGINES from all liability.
25.7. In the event of a dispute, consumers have the right to initiate proceedings before the competent court of their place of residence. Consumers may also use the European Online Dispute Resolution (ODR) platform, https://ec.europa.eu/odr.
26. Complaints and claim limitations (B2B-specific)
26.1. This article applies solely to customers acting in the context of their business, trade, or profession (B2B), and does not apply to consumers within the meaning of applicable consumer protection laws.
26.2. The customer must inspect all products and services immediately upon receipt or completion. Any visible defects, incorrect deliveries, or missing components must be reported in writing within
five (5) business days.
26.3. Hidden defects must be reported in writing within ten (10) business days of discovery, and in any case no later than three (3) months after delivery.
26.4. Failure to submit a complaint within the applicable period shall constitute unconditional acceptance of the goods or services, and all related rights to claim shall be waived.
26.5. All legal claims against 4REVISION ENGINES, including those for non-performance, breach of contract, or damages, shall lapse one (1) year after the date of delivery or completion of services, unless otherwise mandatorily required by law.
27. Repersentation
27.1. The Customer acts solely in its own name and on its own account and shall not represent itself as an agent or authorized representative of 4REVISION ENGINES unless expressly authorized in writing. 4REVISION ENGINES shall have no liability toward third parties purchasing from the Customer. The Customer agrees to indemnify and hold 4REVISION ENGINES harmless from any claims brought by third parties in connection with such downstream transactions.
